These Terms and Conditions govern your use of the FBAR.us website and services. By accessing or using this website, you agree to be bound by these Terms.
1. Services Provided
FBAR.us (“we,” “us,” or “our”) provides services to assist individuals and businesses in preparing and electronically submitting Reports of Foreign Bank and Financial Accounts (“FBAR,” FinCEN Form 114) to the Financial Crimes Enforcement Network (“FinCEN”).
- FBAR.us is not affiliated with FinCEN or any government agency.
- Use of our service is optional; you may file directly with FinCEN without using FBAR.us.
- Our service is administrative and facilitative only.
2. Service Fee
The service fee for FBAR preparation and electronic filing is $327 per submission (the “Service Fee”).
- The Service Fee covers preparation and electronic submission only.
- Legal, tax, or advisory services are not included.
3. Payment Terms & Refund Policy
3.1 Fees and Billing
By submitting payment, you authorize FBAR.us to charge the Service Fee. All fees are billed in advance.
3.2 Non-Refundable Payments
- All payments are final and non-refundable once the filing process has begun.
- This applies regardless of filing outcome, user error, or subsequent user requests.
3.3 Disputed Charges
- Payment disputes or chargebacks may result in voided filings.
- You assume full responsibility for any compliance consequences resulting from disputed or reversed payments.
4. Filing Process & Authorization
FBAR.us acts solely as a submission facilitator.
- Submission is not complete until payment and authorization are provided.
- You are solely responsible for the accuracy and completeness of all information submitted.
- We provide confirmation after successful submission to FinCEN.
5. Incomplete or Unpaid Submissions
If you begin an FBAR submission but do not complete payment and authorization:
- No filing is submitted to FinCEN.
- All data entered is automatically deleted and not retained.
- FBAR.us does not store, recover, or access data from incomplete submissions.
- We do not respond to emails or calls requesting deletion of data for incomplete submissions, as no data is retained.
6. Completed Submissions & Record Retention
If you complete an FBAR submission:
- Your information is retained as required by applicable federal laws and regulatory obligations.
- Retention is necessary for audit, compliance, and recordkeeping purposes.
- Information related to completed filings cannot be deleted upon request while retention obligations apply.
7. User Responsibilities
By using FBAR.us, you agree to:
- Provide complete, accurate, and truthful information.
- Review all information prior to submission.
- Understand and comply with FBAR reporting requirements.
8. No Legal, Tax, or Professional Advice
FBAR.us does not provide legal, tax, or financial advice. Our services are administrative only. You are encouraged to consult a qualified professional regarding compliance obligations.
9. Disclaimer of Warranties
Services are provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including warranties of accuracy, completeness, or fitness for a particular purpose.
10. Limitation of Liability
To the fullest extent permitted by law:
- FBAR.us shall not be liable for indirect, incidental, or consequential damages.
- Total liability shall not exceed the amount paid for the service.
11. Indemnification
You agree to indemnify and hold harmless FBAR.us from any claims, damages, or expenses arising from your use of the services or violation of these Terms.
12. Termination of Services
We reserve the right to suspend or terminate access to the website or services at our discretion, including for misuse or violations of these Terms.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Missouri. Any disputes shall be resolved in applicable state or federal courts located in Missouri.
14. Electronic Communications
By using FBAR.us, you consent to receive electronic communications, which satisfy any legal requirement for written notice.

For questions regarding these Terms:
Incomplete or unpaid submissions are automatically deleted and not retained. Completed filings must be retained for federal compliance and cannot be deleted while retention obligations apply.
FBAR.us does not respond to emails or calls requesting deletion, confirmation, or access to data related to incomplete submissions, or to deletion requests for completed filings subject to retention requirements.
